Home United Management GmbH (“Home United” in the following) offers an exciting concept with co-working workspaces, sports and lounge areas as well as regular events and forms a member network. Various different products are offered.
Co-Working
The General Terms and Conditions for Co-Working apply exclusively. The terms and conditions of members that contradict these are hereby rejected and shall not apply.
The following terms and conditions apply to all services offered by Home United under the name Home United Co-Working and Services. They serve as a framework agreement for all current and future services without the need for express reference. Separate terms apply for event and day tickets (see section “Sale of event and day tickets”).
The services offered are expressly not aimed at consumers.
1 Services and additional services
Home United provides the following services for the co-working spaces, which are already included in the service fee:

Access to the property and use of the co-working spaces

Shared use of the facilities and furniture in the co-working spaces and member areas

Unlimited access to high-speed WLAN internet services

Reception service

Fully equipped kitchenette with coffee, tea and water

Shared use of unique common areas, especially lounges

Possibility to participate in selected member events

Video surveillance in all community areas

All operating and ancillary costs, electricity and heating costs

Cleaning service

Shared use of the workout and sports zone, including equipment, shower and changing areas
The member is entitled to book the optional additional services specified in the Home United price list, in particular meeting and conference rooms. There is no entitlement to full availability at all times.
Depending on the selected tariff, the member receives a certain number of usage quotas. If the agreed usage quota is exceeded, the member must pay separately for additional services. The fee for these services is based on the Home United price list as amended.
The monthly quota expires automatically at the end of the respective month. A transfer to another month and the crediting or reimbursement of unused quotas is excluded.
2 Reception and access
Members/authorized users are looked after by Home United staff from Monday to Thursday from 08:00 - 18:00 and on Friday from 08:00 – 17:00, except on public holidays.
The member has access to the co-working spaces 24 hours a day, 7 days a week. Key cards/transponders are provided to the member to ensure access. The loss of or damage to a key card/transponder must be reported to Home United immediately. The loss or replacement of the key card/transponder must be reimbursed and will be charged in accordance with the Home United price list in the currently valid version.
3 Authorization of use and guests
The member may only use the co-working spaces themselves or through the authorized users specified in the contract. The number of authorized users is limited to the number of workstations booked by the Member. The member must register additional authorized users. The additional authorized users will be charged separately in accordance with the Home United price list as amended from time to time.
The specified authorized users shall be exclusively employees of the member or legal representatives of the member. Home United must be informed immediately of any changes in this regard.
The member may receive guests at Hamburger Ding for professional purposes. Guests of the member must be registered by name with the reception service or the security service in good time. Guests may only stay within Hamburger Ding if accompanied by the member/authorized user. Home United is entitled to refuse access to guests if there is an important reason in the person of the guest or if the reception of guests is unreasonable.
4 Use of co-working space - rules, availability and events
The co-working spaces are made available to the member and the designated authorized users for mobile work. Home United does not owe any specifications that go beyond the general structural requirements, such as compliance with certain maximum temperatures in summer. Competition or product range protection are excluded.
The member must ensure that the co-working spaces are not used for illegal, immoral or otherwise ethically and morally reprehensible business. This prohibition also includes the unauthorized downloading, copying or distribution of copyrighted materials.
The member must treat the facilities of Home United with care in accordance with the Code of conduct and leave them in a serviceable and clean condition at the end of use. The member must take back any items they have brought with them. The member must report any damage to Home United immediately.
If fixed co-working spaces are the subject of the concluded contract, Home United is entitled to assign other, equivalent co-working spaces to the member with one week's notice.
To strengthen the community, Home United will organize various events for members, authorized users and possibly guests. These events will take place at Hamburger Ding, which means that some areas will have to be temporarily closed for preparation and implementation and services may have to be restricted.
The organization of events may result in restrictions on use. Home United will endeavor to provide other workstations within Hamburger Ding for this period if necessary.
The Internet access provided by Home United is operated by external providers. Home United therefore has no influence on time availability and available bandwidth. The member is aware that temporary unavailability and reduced bandwidth may occur due to maintenance or technical difficulties. Internet access may only be used by the member for business purposes.
The member acknowledges that video surveillance is carried out in the common areas for security reasons. The member undertakes to inform its authorized users about the video surveillance.
5 Tariffs, payment modalities
All prices are net prices and are subject to the applicable statutory VAT and relate exclusively to the services offered.
Payments are to be made in advance immediately upon conclusion of the contract. If monthly payments are to be made, these must be paid in advance by the 3rd working day of the month.
Payment shall be made by SEPA direct debit or by credit card.
A flat-rate fee of € 10.00 will be charged for the non-payment of direct debits or the withdrawal of credit notes.
The member is obliged to pay a security deposit to Home United at the beginning of the contract for all claims arising from the contract and its termination. Home United is obliged to keep the security deposit separate from its assets. The security deposit does not bear interest. The security deposit shall be returned within eight weeks after termination of the contractual relationship, but only insofar as Home United has no claims against the member.
6 Incoming mail, use as business address
The Member may use the Home United address as a c/o business address during the term of the contract if booked separately as part of the “Business address and mail service”. The service does not entitle the member to be entered in public directories, trade or commercial registers, unless the address is designated exclusively as a postal address or as a dependent branch office and the company's head office is identified as such.
The “Company headquarters” service can be booked during the term of the contract for memberships of two months or more. The service authorizes the use of the address in normal business transactions and in the imprint of a website. It can be used as the sole business address and all associated registrations and entries are permitted.
By booking the “Business address and postal service” or “Company headquarters” service, mail items are accepted by the Home United reception service. The member grants Home United a written authorization to receive mail for this purpose. Mail acceptance includes all letters and postcards of the daily mail including small parcels and packages up to a maximum of 5 kg. Bulky goods and oversized items are excluded from acceptance. Home United is not obliged to accept registered mail or orders or prepayment services for the member.
The member is obliged to collect the shipments addressed to him/her immediately. Home United reserves the right to charge a storage fee from the third working day in accordance with the Home United price list as amended from time to time.
After a maximum storage period of 90 days, uncollected shipments will be forwarded to the known address at the member's expense, returned to the sender or, if these options are not available, disposed of.
After termination of the contract, the member is obliged to submit a postal forwarding request without delay.
7 Term and termination
When concluding the contract, the member can choose between a fixed term or an indefinite term.
If a fixed term is agreed, the service contract ends automatically at the end of the fixed term. Ordinary termination is excluded during the fixed term.
If the contract has been concluded for an indefinite period, each party has the right to terminate the contract with 30 days' notice to the end of the month.
Irrespective of the agreed fixed term, the right to early termination for good cause remains unaffected for both parties.
Termination requires text form. Any continuation of use after the end of the contract term is hereby objected to.
8 Repairs
Home United is entitled to carry out repair work and structural alterations which serve to preserve the building fabric, avoid hazards or prevent damage, after giving reasonable notice and in consultation.
In the event of imminent danger, no deadline needs to be set. The reduction of the usage fee due to repair work or structural changes is excluded. Compensation for damages is excluded, unless the use of the workstations is interrupted for an unreasonably long time for reasons for which Home United is responsible.
9 Termination of the usage relationship
Upon termination of the service contract, the member is obliged to return the co-working spaces completely cleared of personal items and persons in a condition that corresponds to the condition at the time of handover, taking into account contractual wear and tear. Any damage and soiling must be removed. If the member does not fulfill this obligation, a flat-rate fee will be charged for the final cleaning and any necessary repair of a work area and/or office in accordance with the Home United price list in the currently valid version.
The member must return all key cards/transponders received. If any key cards/transponders are missing upon return, Home United is entitled to charge for them in accordance with the Home United price list as amended from time to time.
Items or documents left behind may be stored at the member's expense and disposed of at the member's expense after a deadline has expired.
10 Data protection
Home United complies with the statutory provisions on data protection. For details on the handling of personal data and the rights of data subjects, please refer to Home United's privacy policy.
Home United assures that all employees receive appropriate instructions on data protection in accordance with labor law.
Home United reserves the right to monitor parts of the Hamburger Ding with video cameras and to store the recordings, in compliance with the provisions of the Federal Data Protection Act and in compliance with the personal rights of the members, insofar and as long as this is necessary and legally permissible in individual cases. The fact of the observation and the responsible body are made recognizable by signs.
11 Warranty, liability
Home United's liability for breaches of obligations arising from or in connection with the Co-Working Services is limited to intent and gross negligence. This limitation of liability as well as any other agreed limitations or exclusions of liability do not apply to damages resulting from injury to life, body or health, which are based on at least a negligent breach of duty by Home United or one of its vicarious agents or for damages due to a breach of essential contractual obligations; in these cases, the statutory provisions apply.
The member shares the use of the areas with other persons. Home United points out that the member is responsible for ensuring that any items brought along are adequately locked. Home United is not liable for stolen items. No liability is assumed for the checkrooms either.
12 Final provisions
Home United is entitled to amend these General Terms and Conditions with effect for the future. The changes become effective if Home United refers to the changes, the member can take note of the changes and does not object within two weeks after receipt of the change notification.
These GTC are subject to the law of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from or in connection with these GTC is Hamburg. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that comes closest to the economic sense and purpose of the invalid provision. Amendments or additions to these GTC must be made in writing.
Booking of event, meeting and conference rooms
The following terms and conditions apply to all contracts for the temporary use of event, meeting and conference rooms in the Hamburger Ding as well as to all services and deliveries provided by Home United. They serve as a framework agreement for all current and future services and are aimed at consumers and business customers.
1 Conclusion of contract
The contract is concluded exclusively by a written declaration of both contracting parties. Verbal collateral agreements are not valid.
Home United is obliged to provide the services ordered by the customer and promised by Home United as well as to make the booked premises available for exclusive use as event and implementation space. The customer is obliged to pay the prices agreed by Home United for these services. This also applies to services and expenses of Home United to third parties arranged by the customer, in particular also for claims of copyright collecting societies.
Home United is entitled to demand a reasonable advance payment or security deposit from the customer in the form of a credit card guarantee, insurance, deposit or surety upon conclusion of the contract. The amount of the advance payment and the payment dates are agreed individually in the contract in text form.
The customer is not permitted to use areas other than those agreed in the contract, unless otherwise agreed in text form in individual cases.
The subletting or re-letting of the rooms or areas provided and their use for job interviews, sales or similar events require the prior consent of Home United in text form.
Should the customer's event require the approval of the responsible local authority, the contract shall only enter into force upon approval. If approval is not granted, neither the customer nor its sponsors or co-organizers can assert claims for damages or compensation against Home United.
2 Withdrawal / Cancellation
If a booking of the event, meeting and conference rooms is not taken up by the customer - for reasons within the customer's sphere of responsibility - the customer shall nevertheless remain obliged to pay the agreed remuneration. The amount of the agreed remuneration shall be reduced
by 100% if the booking is canceled more than 6 weeks before the agreed event;
70% if the booking is canceled less than 6 weeks but more than 4 weeks before the agreed event;
by 40% if the booking is canceled less than 4 weeks but more than 2 weeks before the agreed event;
by 0% if the booking is canceled less than 2 weeks before the agreed event.
The date of receipt of the declaration by Home United is decisive for the termination of the deadline. Such declarations must be made in writing.
The customer undertakes to take out insurance at his own expense against all risks and dangers arising from the realization of the event intended by him.
3 Down payment
For events with a total volume of more than € 10,000.00 and for all private events, a down payment of 30% of the offer amount is due. The invoice for the down payment will be issued 6 weeks before the event.
4 Change in the number of participants and the event
The customer shall notify Home United in text form of any increase or reduction in the number of participants by more than 5% no later than five working days before the start of the event and shall require Home United's consent.
In the event of a reduction in the number of participants by more than 10%, Home United is entitled to redetermine the agreed prices and to exchange the confirmed rooms, taking into account any deviating room rental, unless this is unreasonable for the customer.
If the agreed start and/or end times of the event are postponed and Home United agrees to these deviations, Home United may invoice the additional readiness to perform appropriately, unless Home United is at fault.
The customer may not bring food and beverages to events. Exceptions require an agreement with Home United in text form. In such cases, Home United reserves the right to charge a contribution to cover overhead costs.
5 Note on final cleaning when using confetti
If the customer or one of the guests uses confetti at the event, Home United reserves the right to charge an extra cleaning fee of € 650.
6 Tariffs, payment modalities
All prices are net prices and are subject to the applicable statutory VAT and relate exclusively to the services offered.
Payments are due within 5 days of receipt of the invoice. Payment shall be made by bank transfer, SEPA direct debit or credit card.
A flat-rate fee of € 10.00 will be charged for the non-payment of direct debits or the withdrawal of credit notes.
7 Obligations of the customer
Unless otherwise agreed, the customer is responsible for obtaining all permits and authorizations required for the execution of the event on his own responsibility and at his own expense; Home United will provide the necessary cooperation if required.
In the event that the contract is not concluded due to lack of approval by the competent authority, all services rendered by Home United to date shall be remunerated by the customer.
The customer must comply with the structural and fire protection requirements of Home United. The customer bears the sole responsibility and the sole risk for any consequences resulting from non-compliance with these requirements.
The customer undertakes to comply with all commercial and legal regulations and provisions required for the implementation and operation of the event as well as Home United's domiciliary rights.
The customer undertakes to duly and completely fulfill the copyright obligations arising from the Copyright Act and the Copyright Administration Act vis-à-vis the collecting society.
and, if necessary, to register the event there in good time and to bear all associated costs himself. The customer shall indemnify Home United against any obligations it may have towards the collecting society.
For the duration of the event, the customer is obliged to carefully store the premises as well as the items and assets brought into these areas and rooms by him or third parties and to protect them from tampering and damage of any kind.
8 Data protection
Home United complies with the statutory provisions on data protection. For details on the handling of personal data and the rights of data subjects, please refer to Home United's privacy policy.
Home United reserves the right to monitor parts of the Hamburger Ding with video cameras and to store the recordings as long as this is necessary and legally permissible in individual cases, in compliance with the provisions of the Federal Data Protection Act and while respecting the personal rights of the members. The fact of the observation and the responsible body are made recognizable by signs.

This limitation of liability as well as any other agreed limitations or exclusions of liability do not apply to damages resulting from injury to life, body or health, which are based on at least a negligent breach of duty by Home United or one of its vicarious agents or for damages due to a breach of essential contractual obligations; in these cases, the statutory provisions apply.
The customer shares the use of the areas with other persons. Home United points out that the customer is responsible for ensuring that any items brought along are adequately locked. Home United is not liable for stolen items. No liability is assumed for the checkrooms either.
If the customer is an entrepreneur, he is liable for all damage to buildings or inventory caused by event participants or visitors, employees, other third parties from his area or himself.
10 Final provisions
These GTC are subject to the law of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from or in connection with these GTC is Hamburg. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic sense and purpose of the invalid provision. Amendments or additions to these GTC must be made in writing.
Sale of event and day tickets
The following terms and conditions govern the legal relationship between Home United Management GmbH (hereinafter referred to as the “Organizer”) and the ticket purchaser (hereinafter referred to as the “Customer”) in connection with the sale of event tickets as well as one-day and multi-day tickets (hereinafter referred to as “Tickets”).
The co-working areas are subject to separate GTC that apply independently of these GTC. Additions or amendments to these GTC must be made in writing. Verbal collateral agreements do not exist. Consumers have a right of withdrawal in accordance with the following provisions.
1 Right of withdrawal for consumers
A contract concluded online can be revoked in writing or in text form within two weeks of conclusion of the contract without giving reasons. In the event of effective revocation, the organizer shall refund to the customer any payments already made and not yet used. In order to exercise the right of revocation, the customer must inform the organizer by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of the decision to revoke this contract. In order to comply with the withdrawal period, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
The customer's right of revocation shall expire prematurely if the organizer has provided the service in full and has only begun to provide the service after the customer has expressly given his consent and at the same time confirmed his knowledge that he will lose his right of revocation upon full performance of the contract by the organizer.
In accordance with Section 312g (2) sentence 1 no. 9 BGB, there is no right of withdrawal when purchasing event tickets.
2 Ticket prices and terms of payment
The prices for the tickets will be announced on the website or otherwise. Payment shall be made in accordance with the payment terms stated on the website. Payments are due immediately and without deduction. In the event of late payment by the customer, the statutory provisions shall apply.
3 Ticket booking
The customer may book tickets in accordance with the procedures specified on the website. The organizer reserves the right to set booking conditions and restrictions. A booking only becomes binding upon confirmation by the organizer.
4 Cancellation and refund
Cancellations of tickets by the customer are not permitted. All ticket purchases are final and binding. The organizer reserves the right to make cancellations and issue refunds in accordance with the applicable conditions. In exceptional cases, the organizer may allow cancellation at its own discretion. If an event is postponed, the customer has the right to return their ticket and receive a full refund.
5 Admission and participation
Admission to the event shall be in accordance with the instructions of the organizer on site. Participation in the event requires that the customer is in possession of a valid and undamaged ticket. The organizer may restrict access to events for security reasons or due to maximum visitor capacity.
Ticket purchasers of day tickets are granted access to the co-working spaces from Monday to Thursday from 08:00 - 18:00 and Friday from 08:00 – 17:00 - except on public holidays. Access is granted by the staff of Home United Management GmbH. No transponders or keys will be issued.
6 Changes to or cancellation of the event
The organizer reserves the right to make changes to the event schedule or to cancel the event. Refunds or alternative arrangements in the event of event changes or cancellations will be granted in accordance with the conditions communicated on the website or otherwise. The customer has no right to further compensation in such cases.
7 Exclusion of liability
The organizer is not liable for losses, damages or injuries during the event, unless they are due to gross negligence or intent. The liability of the organizer is limited to the extent permitted by law. This applies in particular to damage caused by other visitors or the loss of personal items.
8 Data protection
The organizer processes the customer's personal data in accordance with the applicable data protection guidelines. The customer agrees to the processing of his data in accordance with the data protection guidelines. The customer can view the organizer's data protection guidelines on the website. The organizer undertakes to take appropriate measures to protect customer information. The customer has the right to request information about the personal data stored about him and to request its correction or deletion, insofar as this does not conflict with any statutory retention obligation.
9 Rights of use
The organizer reserves the right to take pictures or recordings during the event. The customer agrees to the use of such images or recordings for advertising purposes, unless expressly agreed otherwise. The customer grants the organizer the non-exclusive, royalty-free right to use these recordings for an unlimited period of time and space.
10 Other provisions
All other regulations and provisions that are not expressly mentioned in these GTC may be communicated on the organizer's website or elsewhere. The invalidity of individual provisions shall not affect the validity of the remaining GTC.
11 Final provisions
These GTC are subject to the law of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from or in connection with these GTC is Hamburg. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic sense and purpose of the invalid provision. Amendments or additions to these GTC must be made in writing.
Booking and use of the podcast studio
Home United provides customers with a studio in the Hamburger Ding for the recording of podcasts (audio and video recordings). These General Terms and Conditions apply to all contracts concluded in connection with the rental and recording, including technical services, in the podcast studio and are aimed at consumers and business customers.
1 Service description
Home United provides the technically equipped recording studio for the realization of self-produced podcasts for a fee.
Home United advises and supports customers with their podcast project and, if contractually agreed, takes over the audio production. It creates so-called “feeds” and provides these podcast directories. Home United can create and maintain the files on suitable media servers and host the customer's individual podcast website.
Home United is entitled to have the contract or parts of the contract fulfilled by third parties. The performance period is specified in the contractual agreement.
2 Payment
For consumers, all prices are inclusive of VAT. For entrepreneurs, all prices are exclusive of VAT. The services are due for payment within ten days of receipt of the relevant invoice.
Cancellation of services booked by the customer must be made in text form. Any existing right of revocation shall not be affected by these cancellation regulations. Cancellation costs shall be based on the following provisions, whereby the cancellation shall be free of charge if it is made no later than 14 days before the agreed date. The timeliness of the cancellation is determined by the date of receipt by Home United. In the event of a later cancellation, the cancellation costs are based on the following staggered flat rates:
25% of the agreed invoice amount from the 13th to the 7th day before the agreed studio booking,
50 % of the agreed invoice amount from the 6th to the 1st day before the agreed studio booking,
80% of the agreed invoice amount for cancelation less than one day before the agreed studio booking.
3 Revocation instructions for consumers for distance selling contracts
Cancellation policy / right of withdrawal
A contract concluded online can be revoked in writing or in text form within two weeks of conclusion of the contract without giving reasons. In the event of effective revocation, Home United will refund to the customer any payments already made and not yet used. In order to exercise the right of withdrawal, the customer must inform Home United by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of the decision to withdraw from this contract. In order to comply with the withdrawal period, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
The customer's right of revocation expires prematurely if Home United has provided the service in full and has only begun to provide the service after the customer has expressly given their consent and at the same time confirmed their knowledge that they will lose their right of revocation if Home United fulfills the contract in full.
4 Personal responsibility of the customer
The customer is solely responsible for the content and accuracy of the data and information transmitted by the customer. The customer also undertakes not to transmit any data whose content infringes the rights of third parties or violates existing laws. By transmitting data to Home United, the customer confirms that they have complied with copyright regulations. In particular when using protected works, music or language, the customer is responsible for clarifying any third-party rights.
The customer undertakes to provide the cooperation required for the contract so that Home United can perform the contractual service. In particular, the customer must provide Home United with comprehensive information about their wishes and ideas so that Home United can take successful measures to deliver a product that meets the customer's expectations.
The customer indemnifies Home United against all claims asserted against Home United by third parties due to such violations. This also includes reimbursement of the costs of necessary legal representation.
The customer is jointly responsible for backing up the information sent. Home United cannot be held responsible for the loss of information sent by the customer, as Home United does not provide a general data backup guarantee.
No success resulting from the execution of the contract, e.g. in the sense of economic success, is owed. Home United is also not liable for the improper use and/or implementation of the recommendations contained in its services or in the documents provided. The customer must inform themselves in advance as to whether Home United’s suggestions for action are suitable for them or whether these risks can be dealt with. Home United merely makes its services available to the customer. The handling and implementation are the sole responsibility of the customer.
Home United will provide the customer with technical equipment in the podcast studio in perfect condition when the service is booked. The customer is obliged to treat these objects, equipment and technical devices with care at all times. Any misuse is prohibited. The customer shall be liable for any damage.
5 Exclusion of liability
Home United and its legal representatives and vicarious agents are only liable for intent or gross negligence. Insofar as essential contractual obligations (i.e. obligations whose fulfillment is of particular importance for achieving the purpose of the contract) are affected, liability is also assumed for slight negligence. Liability shall be limited to the foreseeable damage typical for the contract. In the event of a grossly negligent breach of non-essential contractual obligations, Home United is only liable to entrepreneurs for the foreseeable damage typical of the contract.
The above exclusion of liability does not apply to liability for damages resulting from injury to life, limb or health. The provisions of the Product Liability Act also remain unaffected by this exclusion of liability.
6 Data backup
Home United does not provide data storage or backups. The customer is responsible for making appropriate backups of their data at regular intervals in order to prevent data loss.
7 Data protection
Home United complies with the statutory provisions on data protection. For details on the handling of personal data and the rights of data subjects, please refer to Home United’s privacy policy.
Home United reserves the right to monitor parts of the Hamburger Ding with video cameras and to store the recordings in compliance with the provisions of the Federal Data Protection Act and in compliance with the personal rights of customers, insofar and as long as this is necessary and legally permissible in individual cases. The fact of the observation and the responsible body are made recognizable by signs.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes as close as possible to the economic sense and purpose of the invalid provision. Amendments or additions to these GTC must be made in writing.
Booking and use of the Towers Zone/Fitness room - only for members of Hamburger Ding
Every member of Hamburger Ding with a monthly membership has the right to use the Towers Zone free of charge, subject to availability. Exclusive usage and participation in the course offer can be booked additionally for a fee. During course times, there is no entitlement to use the Towers Zone for individual training. We reserve the right to make changes. There is no entitlement to participate in a particular course. Additional services can be booked for a fee, depending on the offer and availability. A separate invoice will be issued for the additional services.
The contract for courses is concluded for an indefinite period; each party has the right to terminate the contract with 30 days' notice to the end of the month. The right to early termination for good cause remains unaffected for both parties. Termination requires text form.
The monthly amount must be paid in advance by the 3rd working day of the month. Payment is made by SEPA direct debit or credit card.
Home United is entitled to carry out maintenance work to avoid hazards or to prevent damage or to renew/expand/repair the Towers Zone. In such a case, the member is not entitled to a refund of the membership fee.
Home United observes the legal requirements for data protection. For details on the handling of personal data and the rights of data subjects, please refer to Home United's privacy policy. Home United reserves the right to monitor parts of the Hamburger Ding with video cameras and to store the recordings, in compliance with the provisions of the Federal Data Protection Act and in compliance with the personal rights of the members, insofar and as long as this is necessary and legally permissible in individual cases. The fact of observation and the responsible body are made recognizable by signs.
Home United's liability for breaches of obligations arising from or in connection with the Towers Zone is limited to intent and gross negligence. This limitation of liability as well as any other agreed limitations or exclusions of liability do not apply to damages resulting from injury to life, body or health, which are based on an at least negligent breach of duty by Home United or one of its vicarious agents or for damages due to a breach of essential contractual obligations; in these cases, the statutory provisions apply.
The member shares the use of the areas with other persons. Home United points out that members are responsible for ensuring that any items they bring with them are properly locked. Home United is not liable for stolen items. No liability is assumed for the checkrooms either.
